Restriction on Fit-out Work

The Management shall impose a Predetermined Liquidated Damages Charges (PLDC) for each breach if the contractors breach rules and regulations during Fit-out Work period without prior notice.

1. Hoarding must be installed within the lease line before commencement of Fit-out work - RM500.00
2. No welding works carried out without permission from the Management - RM200.00
3. No hacking without permission from the Management - RM500.00
4. No smoking within the work site/Demised Premises - RM300.00
5. Not to misuse any fire fighting equipment - RM500.00
6. Not to defecate, urinate, or litter inside the building premises - RM300.00
7. Not to stay overnight at site without permission - RM300.00
8. Not to place materials or debris at common areas - RM100.00
9. Not abide by the T&C for Loading/Unloading - RM500.00
10. Not to cook or gamble inside the work site/Demised Premises - RM200.00
11. Illegal tapping of electricity supply in unsafe manner - RM200.00
12. No mat/carpet at the Demised Premise(s) entrance - RM200.00
13. Worker not registered in Contractor's Worker List and not wearing contractor pass - RM200.00
14. No noisy work during complex business hour, 10:00 a.m. to 10:00 p.m. daily - RM500.00
15. No housekeeping after daily work - RM200.00
16. Fit-out workers found cleaning or washing in the mall washroom - RM200.00
17. Debris from Fit-out Work left on lift pit, cargo lift or lift shaft - RM150.00

Note: All amounts stated above are exclusive of 8% Sales and Service Tax (SST).

Terms & Conditions of Fit-out Work

A minimum Fit-out Deposit of RM5,000.00 shall be made to Miri Housing Properties Sdn Bhd before commencement of any fit-out work.

The Fit-out Fee is non-refundable and payable by the Tenant to the Management for water and electricity supplied and miscellaneous expenses incurred during the Fit-out Period.

The Tenant shall be fully liable for any damage to common property caused by contractors, workers or agents. Damage must be made good within THREE (3) days of notice.

A compulsory site construction briefing shall be conducted at least three (3) days before commencement. Ceiling inspection, pre-opening inspection and final inspection must be arranged with Mall Management.

The Tenant and/or Contractors shall insure adequate Contractor All Risk Policy, Workmen's Compensation Policy, Public Liability Policy and other required policies.

Full hoarding must be installed during the whole duration of fit-out work. Air-conditioning, drainage pipe, debris, fire sprinkler, safety equipment, loading/unloading, contractor registration and access control must follow Management requirements.

At least one (1) ABC Dry Powder Fire Extinguisher shall be placed at the renovation site throughout the fit-out period.

All Contractors and Workers must register at the designated security point and obtain a Contractor Pass before entering the premises. Contractor Passes must be worn at all times and returned after completion.

The Management reserves the right to amend, delete or insert these terms and conditions from time to time with immediate effect whenever deemed fit and necessary.
